The airline’s General Conditions of Carriage

Each airline lays out General Conditions of Carriage. You can consult these on the website of the airline you have chosen to fly with, for more information on for example:

  • Conditions on rates, taxes and surcharges
  • Follow-up of reservations
  • Use of personal data
  • Luggage guidelines
  • House rules on board of the plane
  • Existing extra services and, if applicable, valid surcharges
  • Guidelines regarding check-in and boarding times

 

The International Montreal Convention

Apart from airlines’ General Conditions of Carriage, the Montreal Convention (1999) is an international convention on the liability of airlines in case of a passenger’s death, bodily harm, delays and loss of or damage to luggage.  

 

European legislation

Additional to existing legislation, on February 11th, 2004, the European Parliament and Council issued a Regulation on common rules regarding compensation and assistance to air passengers in the event of denied boarding and of cancellation or long delay of flights. This regulation applies to flights listed below:

  • A flight within the EU carried out by an airline based in the EU or outside the EU
  • A flight arriving in the EU and carried out by an airline based in the EU
  • A flight leaving from the EU, carried out by an airline based in the EU or outside the EU

The European Regulation does not apply to other flights, however, the Montreal Convention does apply.
